This IUSLAW seminar familiarizes participants with alternative methods of dispute resolution (ADR). The first part of the seminar approaches mediation and conflict management as a way of avoiding or resolving litigation and of addressing relationships in business with employees, customers and suppliers. It is designed to provide the necessary background, structures, and tools for successful mediation, while also considering negotiation as a separate mode of conflict resolution. In addition to the presentations and skills training sessions, this first part of the seminar will include a visit to a local mediation center.
The second part of the seminar examines the legal issues and processes involved in arbitration. It will be divided into three sections that distinguish between various types of arbitration and the rules, process and other considerations unique to each. The first section will cover domestic U.S. arbitration with particular emphasis on the American Arbitration Association rules. The second section will address the distinctive elements of international commercial arbitration. The third section will be devoted to investment arbitration with special reference to the Convention on the Settlement of Investment Disputes between States and Nationals of other States (ICSID Convention). A visit to the International Centre for the Settlement of Investment Disputes (ICSID) at the World Bank is also planned.
The entire seminar will be led by experienced and respected mediation and arbitration professionals, including senior lawyers from White & Case, Pepper Hamilton and other firms, government-affiliated ADR lawyers, faculty from George Washington University Law Center, as well as senior Court-apppointed mediators and representatives from the American Arbitrtion Association.
Tuition for the "Alternative Dispute Resolution" program is $1,575. Corporate apartment housing arrangements range from $450 - $750 for the period of the program (check-in August 9, check-out August 15.)
